Terms of Service

Effective date: April 23, 2026

1. Agreement

By engaging Kova Studios or using this website, you agree to these Terms of Service. Specific projects may also be governed by a separate written agreement; where they conflict, the signed project agreement controls for that engagement.

2. Services

Kova Studios provides professional digital services, including but not limited to software and mobile app development, websites and web applications, branding and design, and related consulting. Deliverables, timelines, and scope for each client are defined in the proposal or contract for that project.

3. Payment terms

Unless otherwise agreed in writing, project fees are billed as follows: 50% due upfront before work begins, and 50% due on delivery of the agreed final deliverables. Work may be paused if scheduled payments are not received on time.

4. Revisions

Each project includes two (2) rounds of revisions on deliverables covered by the agreed scope. Additional rounds or out-of-scope changes may be quoted separately.

5. Ownership of work

Upon full and final payment for the project, ownership of the custom work product defined in your agreement (such as final source files, design assets, or assigned IP) transfers to you as stated in that agreement. Until payment is complete, Kova Studios retains rights in the work as set out in your contract.

6. Refunds

No refunds are offered after work has begun on a project, including after the upfront payment is received and production has started. If you cancel before work begins, any remedy will follow what is written in your signed agreement or proposal.

7. Limitation of liability

To the fullest extent permitted by law, Kova Studios is not liable for indirect, incidental, special, or consequential damages arising from our services or this site. Our total liability for any claim relating to a project is limited to the fees paid to us for that project, unless applicable law requires otherwise.
